Terms and Conditions
Condiciones Generales de Contratación · My Special Hair
PRECONTRACTUAL INFORMATION
The following General Terms and Conditions (hereinafter the “General Terms”) are provided for your review and understanding. They apply to all distance sales of items and/or products conducted electronically through the online store on the Website https://myspecialhair.com (hereinafter the Website), from the time the BUSINESS sends the CONSUMER the General Terms in the order confirmation document, and not at any earlier time.
These General Terms will remain in effect and valid for as long as they are accessible through the Website. If you disagree with them, you should not use this Website.
THE BUSINESS reserves the right to amend all or part of the General Terms at any time, along with any legal notices, guidelines, and/or rules of use on the Website that, as applicable, replace, supplement, and/or amend these General Terms. This will not affect items and/or products purchased before the amendment.
Such amendments may be made through the Website by any legally permissible means and will be binding while published on the website until validly amended by subsequent versions.
THE BUSINESS informs the CONSUMER that the General Terms can be accessed by clicking the “General Terms and Conditions” link. We recommend that the CONSUMER review the General Terms periodically, as they may change. You can consult the current version at any time at https://myspecialhair.com/condiciones-generales-contratacion
However, the BUSINESS reserves the right, where it considers appropriate, to apply Specific Terms in certain cases that take precedence over these General Terms, giving notice in the appropriate manner and at the appropriate time.
In the event of a conflict between these General Terms and the Specific Terms, the conditions agreed in the latter will always prevail for the conflicting provisions, and only for the items and/or products subject to those specific conditions.
By accepting this contractual document, the CONSUMER:
- Has read and understands the information provided here.
- That they are an individual or represent a legal entity with sufficient capacity to enter into a contract.
- Accepts all conditions and obligations set out here.
- PARTICIPANTS AND IDENTITY OF THE PARTIES
On the one hand,
The BUSINESS is Juan Antonio Espinosa López, N.I.F.: 08834386V, with an address at Calle Lady Smith, 9, 5ºB – 06009 Badajoz (Spain), telephone (+34) 649 313 252, and email info@myspecialhair.com
And, on the other hand,
The CONSUMER, registered on the Website with a username and password, or acting as a guest without registering on the Website, is fully responsible for the use and safekeeping of their credentials and for the accuracy of the personal data provided to the BUSINESS.
Only an individual or legal entity that properly establishes their status and accepts these General Terms and any applicable Specific Terms will be considered a CONSUMER. Together with the Legal Notice, Privacy Policy, and Cookie Policy, these govern our business relationship from the time the BUSINESS sends the General Terms in the order confirmation document, and not at any earlier time.
If you disagree with any part of the terms, you may not purchase any of the items and/or products offered on the website.
Purchases of items and/or products by individuals under 18 or by legal entities that do not meet the requirements set out in these General Terms and Conditions are expressly prohibited.
Orders placed through the Website by a minor who falsifies their information will be considered to have been placed under the supervision and with the authorization of their parents, guardians, or legal representatives.
- PURPOSE OF THE CONTRACT
These General Terms govern the business relationship between the BUSINESS and the CONSUMER arising from orders for items and/or products placed through the Website's online store.
In view of the above, the CONSUMER will only be bound by the General Terms from the time they receive all purchase conditions from the BUSINESS in the order confirmation document.
The contract involves delivery of a specific product in exchange for prior payment of a specified price publicly displayed on the Website.
These Terms and any document expressly referred to in them constitute the entire agreement between the CONSUMER and the BUSINESS concerning the sale and supersede any prior arrangement, agreement, or promise made orally or in writing by the same parties.
The CONSUMER and the BUSINESS acknowledge that they have agreed to enter into a contract without relying on any statement or promise made by the other party, except as expressly stated in these Terms.
- WEBSITE ACCESS AND USE CONDITIONS
Access to the Website is open and free of charge, except for the cost of connecting through the telecommunications network supplied by the user's contracted internet service provider.
Access to most Website content is completely free and requires no prior registration. However, the BUSINESS requires completion of the relevant form before certain services offered on its website can be used, and these may involve payment.
Children under 14 are prohibited from accessing the Website. However, if a minor accesses the Website, they will be presumed to have the prior, express authorization of their parents, guardians, or legal representatives. The BUSINESS nevertheless reserves the right to carry out any checks and verifications it considers appropriate.
Under no circumstances will the BUSINESS be responsible for the accuracy of data provided by users. Each user is solely responsible for ensuring that information provided to the BUSINESS is appropriate, accurate, and precise, or otherwise for any consequences arising from poor-quality data or false or inaccurate statements.
3.1. Requirements to become a registered user
To purchase items and/or products made available to consumers by the BUSINESS, consumers must first register using the forms provided for that purpose and supply at least the registration details marked as required.
To register as a user, you must be over eighteen (18) and provide all information marked as required through the website. Registered users acknowledge that their account is personal and nontransferable. Both individuals and legal entities may register on the Website.
Each registered user will have a login password that is personal, nontransferable, and valid for a limited time. This password must meet minimum length and security requirements. Users may change or recover their password at any time by following the procedure on the Website. The BUSINESS will never have direct access to the password except to provide users with access to the Website.
Accordingly, users must immediately notify the BUSINESS of any event that could allow misuse of their usernames and/or passwords, such as theft, loss, or unauthorized access, so they can be canceled immediately. Until such events are reported, the BUSINESS is exempt from any liability arising from misuse of usernames or passwords by unauthorized third parties.
3.2. Cancellation of registered user status
Users may request to close their website account at any time by using the designated option in the “My account” section of the Website.
After closing their account, users may request to register again. However, the BUSINESS retains the right to refuse registration in the specific cases described in the “Requirements for user status” clause, or where a dispute between the parties remains unresolved or has ended with a finding of user fault or negligence and/or harm to the BUSINESS, its partners and associates, or its users, consumers, or potential consumers.
3.3. Requirements to become a guest user
Items and/or products made available to consumers by the BUSINESS may be purchased as a guest without registering in advance.
Individuals over eighteen (18) and legally established legal entities with sufficient capacity to contract may act as guest users, provided they submit all required information through the Website, including identification details, delivery address, billing information, and selected payment method.
If the consumer has purchased before, after making their purchase and adding the selected items and/or products to the cart, they can access the customer details entered during their previous purchase.
- DESCRIPTION OF ITEMS AND/OR PRODUCTS
In compliance with applicable law, particularly Law 34/2002 of July 11 on Information Society Services and Electronic Commerce, the BUSINESS provides information in each section of the Website about the relevant type of item and/or product, its characteristics, and its price.
- Products related to men's hairpieces and hair systems. These include different bases made from different materials and various hair colors available in stock.
The items and/or products offered, and any others that may be offered through the website in the future, will be delivered in exchange for payment by the CONSUMER. They will give the CONSUMER a right to use them, subject to the time limits, conditions, and provisions of these general terms and any specific terms that may be established.
However, the BUSINESS reserves the right to withdraw, replace, or change items and/or products offered through the Website simply by changing their content.
Accordingly, items and/or products offered on the Website at any given time will be governed by the General Terms then in effect. The BUSINESS may also stop offering access to the aforementioned items and/or products at any time without prior notice.
The descriptions provided in each case will govern the BUSINESS's supply of items and/or products offered to the CONSUMER.
4.1. Availability of items and/or products
Availability of items and/or products offered by the BUSINESS through the Website may vary depending on CONSUMER demand. Although the BUSINESS updates stock periodically, the product requested by the CONSUMER may be out of stock at that time. In that case, the BUSINESS will contact the user by email or telephone to resolve the order issue, offering a similar alternative product, the option to wait until the selected product is back in stock, or cancellation of the order.
4.2. Pricing and price validity
Prices for items and/or products are always displayed in euros (€) and include the applicable Value Added Tax (VAT) or any other applicable taxes at the rates in effect at the time.
VAT is included in these prices. Unless expressly stated otherwise, prices do not include shipping, handling, wrapping, shipping insurance, or any other additional services associated with the product purchased.
Shipping costs for items and/or products are payable by the CONSUMER and will be added to the total price of the selected items and/or products. You will be informed of these costs before confirming the order and completing checkout.
Prices displayed on the Website apply exclusively to the items and/or products offered through that Website while they remain published and are applied automatically at the final stage of checkout.
THE BUSINESS expressly reserves the right to change prices at any time without prior notice. However, the prices shown as in effect when the relevant order is placed will always apply.
4.3. Invoicing
Under Royal Legislative Decree 1/2007 of November 16, approving the consolidated text of the General Law for the Protection of Consumers and Users, consumers and users have the right to receive a paper invoice free of charge for their contracts. Electronic invoices may be issued only if the business has obtained the consumer's prior express consent.
Article 3 of Royal Decree 1619/2012 of November 30, approving the Regulation governing invoicing obligations, provides that for sales not exceeding 400 €, including VAT, or retail sales not exceeding 3.000 euros, including VAT, the BUSINESS may issue a simplified invoice and a copy for sales made through the Website where the buyer acts as an end consumer rather than as a business or professional.
In the above cases where a simplified invoice is permitted, the BUSINESS will not request the buyer's personal data during checkout. If the invoice recipient is a business or professional seeking to deduct tax, or a consumer requesting an invoice to exercise a tax-related right, the BUSINESS must include the recipient's N.I.F., address, and the amount of tax charged.
In keeping with our environmental values, the consumer expressly consents to receiving the simplified invoice electronically. If they prefer a paper invoice, they may request one free of charge by emailing info@myspecialhair.com
By selecting the checkbox, the CONSUMER “I authorize and request delivery of my purchase invoice in electronic format” displayed at the end of checkout, authorizes and expressly consents to the BUSINESS issuing the order's purchase invoice and sending it to their email address in electronic .pdf format, unless the CONSUMER does not authorize this and expressly requests a paper purchase invoice by ordinary postal mail.
To do so, contact Customer Service at (+34) 649 313 252 or email info@myspecialhair.com and request a paper invoice for your order. The BUSINESS will send it by ordinary postal mail to the address provided by the CONSUMER.
The CONSUMER's right to receive a paper invoice may not be made conditional on any payment.
For information about an order, to change shipping or billing addresses, or to correct errors in the information provided, the CONSUMER must contact the BUSINESS at (+34) 649 313 252 or info@myspecialhair.com. In all cases, the order number assigned and shown in the purchase confirmation email must be included in the message subject line or stated during the call.
- PURCHASING PROCESS
The store lets you browse products and place orders in Spanish, French, German, Italian, Portuguese, and Dutch.
You can change the interface language using the language selector. Your order information stays saved in your account.
Invoices and order confirmation emails are issued in Spanish. Check with our team about the languages available for personal support.
To access items and/or products offered by the BUSINESS, the CONSUMER must sign up through the website by creating a user account or proceed as a guest without registering in advance. To do so, the CONSUMER must freely and voluntarily provide the personal data requested in the “Register” form.
The CONSUMER will choose a username and password and undertakes to use them carefully, not to disclose them to third parties, and to notify the BUSINESS if they are lost or stolen or may have been accessed by an unauthorized third party, so the BUSINESS can block them immediately. The CONSUMER is solely responsible for any harm they suffer or cause through misuse of their credentials resulting from their improper safekeeping or use.
The CONSUMER is responsible for handling the username and password obtained during registration confidentially and responsibly and may not transfer them to another person.
The CONSUMER may not choose a username intended to mislead others into identifying them as a member of the BUSINESS, or use offensive or insulting expressions or those otherwise contrary to the law, morality, or good customs.
Once checkout is complete, the BUSINESS's ordering platform will inform the CONSUMER by email of all characteristics, the price, shipping methods, contract date, and delivery time for the purchased product.
Once the CONSUMER account has been created, please note that, as required by Article 27 of Law 34/2002 of July 11 on Information Society Services and Electronic Commerce, the ordering process will follow these steps:
- To purchase items and/or products, the CONSUMER, whether a registered user or a guest without registration, must select the product(s) they wish to buy and add them to their “Shopping Cart” by clicking “Add to cart.”
- The CONSUMER can check that the product(s) have been correctly added to their “Shopping Cart,” which should show the number of items and/or products selected.
- The CONSUMER will see a detailed summary of the items and/or products in their “Shopping Cart,” including:
- Product image
- Product description
- Product availability
- Unit price
- Quantity
- Items and/or products subtotal (VAT included)
- Shipping subtotal (VAT included)
- Taxes
- Total
- The CONSUMER will then see an electronic form to complete with their billing details and full delivery address. Once completed, click SAVE.
- If the delivery address differs from the billing address, the CONSUMER can add a new address by clicking ADD NEW ADDRESS.
- If the delivery address entered in the billing details matches the delivery address, these details will be selected by default when placing the order. Always make sure to update your information if it has changed.
- Before proceeding with the order, the CONSUMER must carefully read these general terms and the basic data protection information provided and accept them in full by selecting the following checkbox:
□ I agree to the basic data protection information provided and to the General Terms and Conditions, accepting both without reservation.
- The CONSUMER will pay for their order using one of the payment methods provided by the BUSINESS on the Website.
- The order will be processed once the CONSUMER clicks the button “Confirm my purchase” at the bottom of the page.
- Once the purchase is complete, the CONSUMER will receive a purchase confirmation, the “Proof of Purchase,” at the email address provided. This document serves as evidence of the transaction and may be printed. The order confirmation and Proof of Purchase are not valid as an invoice.
- To check the status of pending orders, go to “My account.” After signing in on the login page, you can access your orders page, where orders are listed by date with an indication of their status.
Communications, purchase orders, and payments involved in transactions on the Website may be archived and retained in the BUSINESS's computerized records as evidence of the transactions, always subject to reasonable security measures and applicable laws and regulations. Particular regard will be given to REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (GENERAL DATA PROTECTION REGULATION – GDPR EU 2016/679), Organic Law 3/2018 of December 5 on Personal Data Protection and the Guarantee of Digital Rights (LOPDGDD 3/2018), and Users' rights under this Website's privacy policy.
- TECHNICAL MEANS TO CORRECT ERRORS
If the CONSUMER provides incorrect information when placing an order on the Website, they may change it by contacting the BUSINESS through the Website's contact form, emailing info@myspecialhair.com, contacting CUSTOMER SERVICE at (+34) 649 313 252, or using the personal “My account” area.
- PAYMENT METHODS
To make payment, the CONSUMER must follow all instructions displayed on the Website. Payment for the items and/or items and/or products may only be made using the payment methods indicated on the Website at the time.
Credit and/or debit card payments are subject to checks and authorization by the card issuer. If the issuer does not authorize payment, checkout cannot continue, the order will be canceled automatically, and the purchase of the requested service will be considered not to have taken place. The order price and any applicable taxes will be displayed when placing the order.
To strengthen the security and protection of online purchases, the BUSINESS has implemented processes to improve transaction security by incorporating a payment service provider and a banking intermediary that ensure transaction confidentiality and security, requiring authentication for every purchase through the website where required by payment security regulations (PSD2).
All payment orders are identified by a code generated by the payment provider. Without this code, no transaction will be authorized by the relevant bank. This code allows the BUSINESS to collect payment without storing payment card details.
Under no circumstances will the BUSINESS store data provided by CONSUMERS through the payment gateway on its own computer systems. Such data will only be retained while the purchase and payment are processed and until the withdrawal period has expired.
Several payment methods are available on the Website so the CONSUMER can choose how to pay for their order:
To make payment, the CONSUMER must follow all instructions displayed on the Website. Payment for items and/or products may only be made using the payment methods indicated on the Website at the time.
Credit and/or debit card payments are subject to checks and authorization by the card issuer. If the issuer does not authorize payment, checkout cannot continue, the order will be canceled automatically, and the purchase of the requested service will be considered not to have taken place. The price of the items and/or products and any other applicable taxes will be displayed when placing the order.
Several payment methods are available on the Website so the CONSUMER can choose how to pay for their order:
Stripe: You can pay by card through Stripe. The order summary shows a 1.6% fee on the cost of products and shipping before you confirm payment.
– PayPal: the CONSUMER may pay for their order through the PayPal online payment platform. With this payment method, they may also use a credit or debit card and choose to spread payment over three months without interest. This payment method carries an additional charge of 3% of the purchase value.
– Bizum: the CONSUMER may choose to pay for their order using Bizum, an instant payment system for transfers between individuals and purchases from businesses. To use this payment method, the CONSUMER only needs to have their bank's app installed and enter the BUSINESS's phone number to send the amount of the online store purchase.
– Bank transfer: the CONSUMER may choose to pay for their order by bank transfer to the BUSINESS. Click the website's “direct bank transfer payment” link and follow the instructions. When purchasing the service and selecting this payment method, an email with the BUSINESS's bank account number for the deposit will be sent once the transaction is confirmed.
– Klarna: the CONSUMER may pay for their order through the Klarna online payment platform. With this payment method, they may also use a credit or debit card and choose to spread payment over three months without interest. This payment method carries an additional charge of 5% of the purchase value.
The CONSUMER's purchase may be delayed for fraud screening. It may also be held for longer for a more thorough investigation to prevent fraudulent transactions.
- VALUE-ADDED TAX
Under Article 68 of Law 37/1992 of December 28 on Value Added Tax, delivery of items and/or products will be deemed to take place within the territory subject to Spanish VAT if the delivery address is in Spain, except for the Canary Islands, Ceuta, and Melilla, where their respective tax rates apply. The applicable VAT rate will be the legally established rate in effect at the time for the specific item concerned.
Likewise, under COUNCIL DIRECTIVE (EU) 2017/2455 of December 5, 2017, amending Directive 2006/112/EC and Directive 2009/132/EC regarding certain value added tax obligations for supplies of services and distance sales of goods, purchase orders will be deemed delivered and/or supplied in the European Union Member State where the address shown on the purchase order is located. The VAT rate applicable in that Member State will therefore apply.
Orders shipped to the Canary Islands, Ceuta, and Melilla are exempt from VAT under Law 37/1992 and DIRECTIVE (EU) 2017/2455, without prejudice to any taxes and duties applicable under the laws of each territory. The CONSUMER should bear in mind that destination taxes and customs duties may apply and become payable in these territories under current law, and that these may be their responsibility.
For locations other than those listed above, purchase orders will be subject to the laws in effect where delivery and/or supply takes place. The CONSUMER should bear in mind that destination taxes and customs duties may apply and become payable under local law, and that these may be their responsibility. For more information, the CONSUMER should contact the customs office at the destination.
- ORDER PROCESSING
Once receipt of payment for the full product amount indicated at checkout has been verified, the BUSINESS will begin processing the order.
THE BUSINESS does not guarantee the price offered in this order for more than five days from its date. If payment is not made within five days using the designated methods, the price may change.
For this purpose, the CONSUMER consents to the BUSINESS sending the invoice electronically to the email address provided. The CONSUMER may withdraw this consent at any time by emailing info@myspecialhair.com to receive a paper invoice.
We also recommend that the CONSUMER print and/or save a copy of the terms of sale on a durable medium when placing their order, along with the acknowledgment of receipt sent by THE BUSINESS by email.
THE BUSINESS will deliver the items and/or products exactly as shown on the website.
The goods are shipped to their destination with comprehensive insurance arranged by the BUSINESS. The insurance cost is included in the handling and shipping charge.
If any delivery issue is identified, the CONSUMER must contact us using the contact form and include all details relating to the delivery issue in the message.
- SHIPPING CONDITIONS FOR ITEMS AND/OR PRODUCTS
Items and/or products purchased through the Website will be properly packed in a printed zippered bag, with bubble wrap protecting the product, and sent to the postal address specified in the order form through Nacex and Correos Premium, the carriers contracted by the BUSINESS for this purpose. The address may not be a P.O. box or a public place such as a street, square, station, airport, or similar location.
Delivery time for items and/or products depends on the shipping destination and in all cases begins when the BUSINESS receives payment for the order. However, it will not be liable for failure to meet these dates where the reasons are beyond its control.
If the BUSINESS cannot perform the contract because the purchased goods are unavailable, the CONSUMER will be informed of this unavailability by email and the BUSINESS will refund any sums paid under the contract without undue delay.
10.1. Order delivery times
Orders placed by the CONSUMER through the Website can currently be shipped to residents in any locality in mainland Spain, the Balearic Islands, the Canary Islands, the autonomous cities of Ceuta and Melilla, European Union member countries, and Latin America.
Under Regulation (EU) 2018/302 of the European Parliament and of the Council of February 28, 2018, on addressing unjustified geo-blocking and other forms of discrimination based on CONSUMERS' nationality, place of residence, or place of establishment within the internal market, amending Regulations (EC) No. 2006/2004 and (EU) 2017/2394 and Directive 2009/22/EC, consumers and users residing in European Union countries have the right to freely access any online store regardless of the European country in which they reside, as blocking access to an e-commerce website is prohibited.
Once payment for the order has been confirmed, if the requested items and/or products are available, the order will leave the BUSINESS's warehouse for the delivery address specified by the CONSUMER.
Order delivery times depend on the physical location of the CONSUMER or, where applicable, the different recipients, as well as the time the order is placed (official mainland Spanish time).
For orders of any type of item and/or product offered on the Website that is in stock and placed before 12:00 p.m., once payment has been confirmed, delivery will be made to the address freely chosen by the CONSUMER within the following estimated delivery times:
| Delivery area | Delivery time |
| Mainland Spain | 24 to 72 business hours |
| Balearic Islands | 48 to 72 business hours |
| Ceuta | 3–4 business days |
| Melilla | 3–4 business days |
| Canary Islands | 3–4 business days |
| European Union | 4–5 business days |
| Latin America | 7–10 business days |
For orders of temporarily out-of-stock items and/or products or custom-made products, the CONSUMER may contact the BUSINESS by email or telephone to ask about their availability date and corresponding delivery time.
If shipping is delayed and we cannot meet our commitment to deliver the order within the estimated delivery period, the BUSINESS will contact the CONSUMER by email or telephone to resolve the issue, offering a similar alternative product, the option to wait until the selected product is ready to ship, or cancellation of the order.
As a general rule, unless circumstances arise from customization of the items and/or products or unforeseen or extraordinary circumstances occur, we will ship the selected product(s) within the delivery times indicated above and, in any event, within a maximum of 30 business days from the order confirmation date.
10.2. Shipping costs for items and/or products
Order shipping costs, including applicable taxes, will be shown during checkout before the order is finalized and are detailed below:
| Delivery area | Shipping | Shipping costs |
|---|---|---|
| Spain | Correos | 4,50 € |
| Spain | NACEX | 7,50 € |
| Europe outside Spain | Shipping to Europe | 14,90 € |
10.3. Free Correos shipping in Spain
Spain: Correos €4.50, free on €60 or more in items after discounts. NACEX: always €7.50. Europe outside Spain: €14.90. U.S. shipping is not available in checkout.
10.4. Failed delivery
If delivery of your order is not possible, the Website's customer service team will contact the CONSUMER to arrange a new delivery date if they will not be at the delivery location at the agreed time.
If 15 days have passed since your order became available for delivery and it has not been delivered for reasons not attributable to the BUSINESS, we will understand that you wish to withdraw from the contract and consider it terminated. As a result, we will refund all payments received from you, including delivery charges (except additional costs resulting from your choice of a delivery method other than the least expensive standard delivery option we offer), without undue delay and, in any event, within a maximum of 14 days from the date we consider the contract terminated.
Please note that transportation resulting from termination may incur an additional cost, and we will be entitled to charge you the corresponding costs.
If for any reason we cannot meet the delivery date, we will inform you and offer you the option to proceed with the purchase with a new delivery date or cancel the order for a full refund of the price paid.
For the purposes of these Terms, “delivery” will be deemed to have occurred, or the order to have been “delivered,” when you or a third party designated by you takes physical possession of the items and/or products, evidenced by a signed acknowledgment of receipt at the agreed delivery address.
THE BUSINESS accepts no liability where an order cannot be delivered because the information provided by the CONSUMER is false, inaccurate, or incomplete, while accepting any other liability relating to failure to deliver the order.
Without prejudice to the above, THE BUSINESS must take the measures expected of a diligent merchant to ensure delivery can take place at the agreed time.
If the CONSUMER does not receive the order within the delivery times established in these terms, calculated from the date it leaves the warehouse, they may contact us at (+34) 649 313 252 or by email at info@myspecialhair.com
THE BUSINESS will make every effort to meet the stated delivery time. If it becomes aware that this will not be possible for any reason, it will notify the CONSUMER by email or telephone.
THE BUSINESS will inform the CONSUMER that a product is unavailable as soon as it is notified by the supplier, or that it cannot supply the requested product.
The CONSUMER may choose to cancel the order request or request a quote for an alternative product with similar characteristics.
10.5. Promotional codes: Terms and conditions
THE BUSINESS may issue single-use promotional codes as an incentive for CONSUMERS. If the BUSINESS believes a CONSUMER has deliberately circumvented the measures restricting their use, it may adjust that CONSUMER's subsequent order accordingly. When using promotional codes, CONSUMERS are responsible for checking that the relevant promotion or discount is accurately reflected at payment and used within its applicable period.
CONSUMERS must contact the BUSINESS immediately if they detect an error or a promotional code is not correctly applied to their purchase.
The offers and promotions provided by the BUSINESS may vary according to its needs. Each promotional code made available to CONSUMERS will specify the items and/or products to which it applies, its benefits, and its expiration date.
The offer is subject to valid registration and acceptance of the website's standard terms and conditions.
The promotional code is nontransferable and may not be sold or exchanged. Only one promotional code may be used per CONSUMER, and it applies exclusively to purchases of items and/or products through the online store. Use of any promotional code constitutes acceptance of these terms and conditions.
- STATUTORY RIGHT OF WITHDRAWAL
11.1. Scope (B2C)
The right of withdrawal governed by this clause applies exclusively to CUSTOMERS legally classified as consumers and users (B2C), in accordance with applicable consumer and user protection laws.
11.2. Withdrawal period and exercise of the right (B2C)
Under Royal Legislative Decree 1/2007 of November 16, the CUSTOMER may withdraw from the contract within fourteen (14) calendar days of receiving the products, without giving a reason or incurring any penalty. The right of withdrawal may be exercised through the digital interface provided by the BUSINESS on the Website. Once the request is received, the BUSINESS will send the CUSTOMER an acknowledgment of receipt on a durable medium.
Click here to access the digital withdrawal interface.
11.3. Consequences of exercising the statutory right of withdrawal
Where the right of withdrawal legally applies, the BUSINESS will refund the CUSTOMER the full amount paid, including, where applicable, shipping costs for the standard delivery option initially offered, within a maximum of fourteen (14) calendar days from the date it is informed of the withdrawal decision.
The refund will be made using the same payment method used by the CUSTOMER for the initial transaction, unless they expressly agree otherwise and the alternative method does not incur any additional cost.
However, under applicable law, the BUSINESS may withhold the refund until it has received the returned goods or the CUSTOMER has provided reliable proof of return, whichever occurs first.
The CUSTOMER must return the products properly protected and in suitable condition and is responsible for any reduction in value resulting from handling beyond what is necessary to establish their nature, characteristics, or functioning.
The CUSTOMER is responsible for the direct costs of returning the products, unless expressly stated otherwise or the return is due to a product's lack of conformity or another cause attributable to the BUSINESS.
When exercising the right of withdrawal, products do not have to be returned in their original packaging, provided they are properly protected during transportation.
11.4. Exclusions from the right of withdrawal
Under Article 103 of Royal Legislative Decree 1/2007 of November 16, the right of withdrawal does not apply, among other cases, to:
- Services whose performance has begun with the CUSTOMER's prior express consent and acknowledgment that they will lose their right of withdrawal once the contract has been fully performed by the BUSINESS.
- Goods or services whose price depends on financial market fluctuations beyond the BUSINESS's control.
- Products made to the CUSTOMER's specifications or clearly personalized.
- Products that may deteriorate or expire quickly.
- Sealed products unsuitable for return for health protection or hygiene reasons that have been unsealed after delivery.
- Products that, after delivery and by their nature, have been inseparably mixed with other goods.
- Sealed audio or video recordings and sealed computer software unsealed by the CUSTOMER after delivery.
- Daily newspapers, periodicals, or magazines, except subscription contracts for the supply of such publications.
- Contracts concluded at public auctions.
- Alcoholic beverages whose price was agreed when the contract was entered into and whose delivery cannot take place within thirty (30) days, where their value depends on market fluctuations beyond the BUSINESS's control.
- Accommodations for purposes other than housing, transportation of goods, vehicle rentals, catering, or services related to leisure activities where the contract specifies a particular date or period of performance.
- Digital content not supplied on a tangible medium, where performance has begun with the CUSTOMER's prior express consent and acknowledgment that they lose their right of withdrawal.
Application of any of the above exceptions depends on the specific nature of the product or service purchased and compliance with the legal requirements in each case.
11.5. Liability for product handling
The CUSTOMER is responsible for any reduction in product value resulting from handling beyond what is necessary to establish its nature, characteristics, or functioning.
Excessive handling includes, among other cases:
- Actual use of the product.
- Alteration, modification, or tampering with its components.
- Removal of labels, seals, or identifying elements.
- Returning the product without all supplied accessories or documentation.
In such cases, the BUSINESS may apply a proportionate deduction from the refund amount.
Any deduction must be objective, proportionate, and duly justified by the condition of the returned products.
- STATUTORY WARRANTY FOR ITEMS AND/OR PRODUCTS
All items and/or products purchased by the CONSUMER through the BUSINESS's Website are covered by a statutory guarantee against any lack of conformity that arises, subject to the conditions and evidentiary requirements set out in Royal Legislative Decree 1/2007 of November 16, approving the consolidated text of the General Law for the Protection of Consumers and Users and other supplementary laws.
However, due to the perishable and customizable nature of these items (toupees, hairpieces, and hair systems), the following provisions apply:
Home and duration of the statutory warranty
The warranty period begins on the date shown on the invoice, purchase receipt, or delivery note.
The maximum warranty period is 14 calendar days from delivery of the goods, given that these products are subject to wear and require specific care.
Conditions for the validity of the statutory warranty
Product conformity is guaranteed provided the instructions for use and maintenance supplied by the BUSINESS are followed.
The warranty excludes damage resulting from misuse, lack of care, improper handling, or exposure to unsuitable conditions such as moisture, extreme heat, or nonrecommended chemicals.
Conformity of the product
Items and/or products are deemed to conform to the contract if they meet all of the following requirements:
(i) They match the description provided by the BUSINESS and have the qualities of the product presented to the CONSUMER as a sample or model through the Website.
(ii) They are suitable for the purposes for which items and/or products of the same type are ordinarily used.
(iii) They offer the quality and performance normally found in a product of the same type that the CONSUMER can reasonably expect, taking the product's nature into account.
Complaintsprocedure
The CONSUMER must notify the BUSINESS's CUSTOMER SERVICE of any lack of conformity through a simple statement, including the invoice and a detailed description of the problem.
Where appropriate, the BUSINESS will arrange repair, replacement, a price reduction, or termination of the contract at no cost to the CONSUMER.
Repair or replacement of the product
Where repair or replacement is appropriate, the CONSUMER will make the goods available to the BUSINESS, which will collect the replaced goods at its own expense in the manner that causes the least inconvenience to the CONSUMER, depending on the type of goods.
The goods sent for repair or replacement must be the same as those originally delivered by the BUSINESS, and the invoice or proof of purchase must be included.
The product must be fully packaged and protected. If it arrives at the BUSINESS's address with damage attributable to inadequate packaging, the repair may not be covered by the warranty, and the CONSUMER will be informed.
For repairs and replacements, free service includes shipping costs, labor, and necessary materials.
Exclusions from the statutory warranty
The statutory guarantee excludes deficiencies caused by misuse, lack of care, improper handling, or defects resulting from any external cause.
Damage caused by external factors such as weather, fire, water, abnormal product use, burns, cuts, rubbing, creases, scratches, animals, accidental falls, or incorrect use is not covered.
Claims will not be accepted for loss of natural shine, color deterioration from sun or heat exposure, contact with chemicals, or cleaning treatments other than those recommended.
Limitations of the trader's liability
THE BUSINESS is not required to compensate the CONSUMER or third parties for the consequences of misuse of the goods, including direct or indirect damage, personal accidents, damage to property other than the purchased goods, loss of benefits, or lost profits.
It is essential that customers carefully review the instructions for use and care included with the product to ensure its proper preservation and enjoyment.

- RETURN OF ITEMS AND/OR PRODUCTS
The CONSUMER may return items and/or products purchased through the website that arrive in poor condition due to a flaw or manufacturing defect (provided the defects were not caused by the CONSUMER's improper handling or use), items and/or products that differ from those ordered, or those damaged in transit, within a maximum of fourteen (14) calendar days from the day the CONSUMER or a designated third party other than the carrier receives the purchased product, or receives the last item if a single order is delivered in multiple shipments.
If the CONSUMER believes that a product does not conform to the contract at the time of delivery, they must contact the BUSINESS as soon as possible at info@myspecialhair.com to begin the return process, providing the product details, order number, and proof of purchase, and documenting the defect/damage with photographs or videos showing that the product is actually damaged, deteriorated, or defective, or does not meet the criteria they were looking for.
To be returned, the product must be in perfect condition and its original state (not damaged or soiled, unwashed, not excessively styled, dyed, or cut, with tags attached and in its original box), together with all promotional accessories and spare parts, where included. Otherwise, the return will be rejected.
Transportation costs for returning items and/or products to the BUSINESS's warehouse are always payable by the CONSUMER, except for returns of products damaged in shipping, differing from those ordered, or showing manufacturing defects, in which case the BUSINESS will pay.
To make a return, use the carrier of your choice and send it prepaid to the BUSINESS's address: Calle Lady Smith, 9, 5ºB – 06009 Badajoz (Spain). You may use the same shipping box in which you received your order or a new one if necessary.
Once the original goods and complete product have been received, their condition will be checked and the BUSINESS will inform the CONSUMER by email whether they are entitled to an exchange for a new product or a refund. This process may take 5 to 7 business days from receipt of the item at our warehouse.
The BUSINESS may withhold the refund until it has received the goods or the CONSUMER has provided proof of return of the items and/or products, whichever occurs first.
Any refund the BUSINESS owes the CONSUMER due to a price reduction or termination of the contract will be made without undue delay and, in any event, within fourteen (14) days from the date the BUSINESS is informed of the consumer's decision to exercise the relevant right. During high-volume shopping periods such as sales, promotions, Halloween, Black Friday, Christmas, etc., processing the refund may require an additional 1 to 3 business days.
The BUSINESS will make the refund described above using the same payment method the consumer used to purchase the goods, unless the parties expressly agree otherwise and this does not result in an additional cost to the CONSUMER. The BUSINESS may not charge the consumer any fee for the refund. The refunded amount will not include any original shipping costs.
For instructions on returning a product damaged in shipping, incorrect, or defective, contact our CUSTOMER SERVICE AND AFTER-SALES SUPPORT directly at (+34) 649 313 252 or by email at info@myspecialhair.com
